Based on these requirements, Daly told Winston that he had a van the fit Winston’s requirements and a van was offered for sale and accepted based on Daly’s representations. In fact, Daly also noted that the van in question had hardly been broken in. It is a fundamental rule of contract law that the parties to a contract enter into a contract on the basis of an understanding that they will receive the benefit bargained for and forming the inducement to enter into the contract.1 In addition, should one of the contracting parties fail to perform as mandated pursuant to the contract, the party losing the benefit bargained for and reflected in the contract for sale, is entitled to compensation for that loss.2 When the party loses the entire benefit of his or her bargain, he is entitled to treat the contract as terminated.3 Under the contract for the sale of the van, Winston was promised and expected to receive a van capable of replacing the van lost in the conduct of the antique shop’s business. The truck however, turned out to be inadequate as a replacement vehicle. The question is therefore whether or not the van’s failure to live up to expectations amounts to a breach of the contract on Daly’s part. Daly did make certain representations or as it turned out, misrepresentations that the van in question was fit for purpose. Misrepresentation occurs when false information is communicated and that false information induces the other party to enter a contract to which the false information applies.4 Misrepresentation can be made fraudulently or negligently or innocently.5 It is difficult to discern from the facts of the case for discussion whether or not the false information provided by Daly that the van was fit for its intended purpose was negligent, innocent or fraudulent. However, as a skilled or experienced salesman, it can be assumed that at the very least, Daly ought to have known whether or not the van was fit for purpose. It is therefore reasonable to assume that Daly’s misrepresentation was negligent at the very least. Regardless, it will be for Winston to prove that he relied on the information communicated to him or was induced by that information to enter into the contract.6 It can be assumed from the facts that Winston did in fact rely on Daly’s communication of facts since he was looking for a specific van with specific requirements and communicated those facts to Daly. Fit for Purpose Quite apart from misrepresentation, Winston can consider taking action against Daly under statute. By statutory law, it is an implied term of contracts for the sale of goods that goods purchased for a specific purpose are fit for purpose. Acquiring Personal Freedom On a cold January day, a performance broke all barriers. The crowd erupted as the curtains opened to reveal the silhouette of a rock legend. The music initiated moves that seemed to defy explanation. Long, sensuous legs captured the audience as they moved with lightning speed while voluptuous red lips seemed to pour lyrics like a fountain. Some people were in shock about who was performing, while some mystified by how the artist seemed to control the stage. The singer was creating questions with every gyration during the unstoppable performance. No one, including me, could believe what was happening on stage. How someone’s attitude can change over a small amount of time. When I entered high school, I was very self-conscience about what I did and how I acted. This mental approach really dampened my creative side and it kept me from doing a lot of things I find fun now. By the middle of my sophomore year, I was ready to do something that would stir things up a bit and get the big wheels turning. Winterfest was only a week away and I, along with the rest of the school, was ready for a little break from the monotonous everyday routine. There was a competition scheduled for Thursday which was between different â€Å"air guitar† performances. I had been to a concert earlier in the year and saw Tina Turner perform one of her most famous songs, â€Å"Proud Mary.† To my mind, the idea of dressing like Tina Turner and performing on stage was absurd. I thought about it for a few days and decided that this could be something that might break the self-conscience chains holding my spirit down. I knew it would be hard and some people might think it a little overboard, but there was only one way to fin... ...ual attire rather than the leather mini-skirt. A glint in my eye seemed to light the way out of the dim-lit bathroom. Today, when confronted with a challenge, I just look back at this experience to help me through it. After I performed in front of the school in a skirt and high heels, some things seem minuscule. By overpowering my self-conscience feelings, I am now able to do things without caring how people might view me. I have noticed that my newly gained social confidence helps me through everything from interviews to relationships. On a cold January day, a performance broke all barriers blocking me from my goals. I did something I had never done and discovered that what others thought would not control my life any longer. On that day, my spirit escaped the bounding chains and set my big wheels in motion with no sign of stopping anytime soon.

Influences of Eastern Religions In My Life The two readings that have impacted, influenced, and challenged my view of religion are the Bhagavad Gita (BG) and the basic writings of Zhuangzi. I have chosen these readings because of their influence and insight they have unveiled to me in my present station of life. In particularly, from the Bhagavad Gita, Krishna’s teaching in chapter 2 â€Å"The Path of Reality,† and from Zhuangzi; his perspectives from his writings in section 3 â€Å"The Secret of Caring for Life† and section 18 â€Å"Supreme Happiness. Both have spoken to me from a different context, within a different set of parameters than that of my own faith and practice; bringing me to a fresh and profound understanding of some of my own enduring dilemmas within my own religious tradition. I currently consider myself a Mormon (Latter-day Saint) and have been for the last 13 years. Up until this REL 101 class I was not familiar with these eastern religious t raditions and perspectives.The Path of Reality, as titled for chapter 2 in the (BG), has opened my eyes to its valuable lesson, which I am thankful for its influence. The concept of non-attachment is prevalent here in this chapter. Non-attachment means to live life like a lotus leaf, without being touched by it or polluted by it. It is living free from the encumbrances of life and the attractions and distractions it has to offer, not passively by running away from them, but actively by developing equanimity (yoga) and Self(atman)-awareness (Ch. v. 30-48). According to the (BG) contact with sense objects results in attachment (Ch. 2 v. 58). In the following versus it expounds this thought: When we do not have the right discrimination we lose the ability to choose wisely, which results in the consequences of karma that binds us to this world and samsara. Though I have not embraced every facet of Hinduism, the powerful language found in the (BG) has strengthened me to tackle present-da y ongoing trials in my own life with new vigor and enthusiasm.What I would just simply categorize as sin or an evil deed from the presets of my own religious tradition, I have found new terminology and explanation for my behavior that has been empowering and invigorated my ambition to overcome this adversity I have been facing in my life. The other reading that has had a positive impact on me is the basic writings of Zhuangzi. Section 3 â€Å"The Secret of Caring for Life. † Here, Zhuangzi conveys a story about Cook Ding, the butcher, which draws a more favorable portrait of specialization (Zhuangzi, p. 45-46).His example is consistent with Aristotle's observation that human life offers no more of a fulfilling activity than the exercise of some acquired skill. Highly honed skills invite paradoxical, almost mystical, description. In performance we seem to experience a unity of actor and action. Such practice is a way of losing oneself as one might in contemplation or in a tran ce. Zhuangzi considers Cook Ding possessing remarkable skill, almost effortlessly, because this skill in action is done concurrently while being one with the Dao (p. 45-46).The accuracy of our own actions sometimes mystifies us. We do not understand how we did it; we certainly cannot explain it to others. I found this story intriguing because I am one who values self-mastery. As an ex-collegiate athlete I can relate to Cook Ding, but would rather call it â€Å"being in the zone. † Although I am not a follower of Daoism there are many things I find appealing in this tradition; this mystical story being one of them. The other section from Zhuangzi â€Å"Supreme Happiness† has aided the recent loss of my great grandmother â€Å"Grandma Bea. My great grandma was a pillar of faith in my life and a great exemplar in many arenas of life. At times, naturally, I found myself grieving over her loss. Reading this section I felt that it gave me fresh insight to coping with this l oss. At first, I found myself more like Huizi, rather than Zhaungzi. As pondered this for the past couple weeks my grief has subsided. When Zhuangzi’s wife died and he beat on a drum instead of mourning for her, he answered his Huizi by explaining that perhaps his wife had evolved into a happier existence than that which she had enjoyed while in human form.It was not wrong to have loved her and to miss her, but it was wrong to mourn her change from one form to another (Zhuangzi, 115). Zhuangzi’s parables point out that one cannot be certain what is best for other people and that one should therefore avoid imposing tentative and uncertain values on others. He also enlightens the reader about the realities of death and the clarity that comes from having a higher knowledge which gives greater understanding and ability to cope with death. He states, â€Å"If I were to follow after her awling and sobbing, it would show that I don’t understand anything about fate. So I stopped (115). Thus, death is simply a phase in the turning of the wheel of fortune that is the Dao. The turning of the wheel voids the identity and disintegrates the material body of the dead person. From the standpoint of the Dao, however, no state of being is more desirable than another. As a natural event in the cycle of human life, death is neither to be feared nor to be sorrowed over. This perspective has given me new insight and ability to cope with my recent loss.

Euthanasia is painless killing of a patient suffering from an incurable and painful disease or in an irreversible coma. All motives are compassionate for a patient, whether the killing is by a direct action, such as a lethal injection, or by failing to perform an action necessary to maintain life. The euthanasia movement started in l935 in Britain, in l938 in the U S A, and in l980 in Canada (catholicapologetics). Opinion polls show average support of 60 percent in the USA, 74 percent in Canada, and 80 percent in Britain (catholicapologetics). Many people disagree that death is a decision upon GOD but, why make a person suffer more pain being alive? Today, many people are against euthanasia because; they feel that it is murder. This is because there are certain cons of euthanasia that compel them to think this way. Firstly, medical science has made great advancements in the recent years. There is almost always a cure available for a disease. So euthanasia should not be kept as a viable option. One of the other cons of euthanasia is that sometimes there is pressure from family members who want to induce death for their own gains. The doctor may get influenced by the ideas that are put forward by them. In that case it becomes very difficult to decide whether euthanasia was completely necessary or was influenced by the family members. Sometimes even medical science cannot predict with certainty the fate of a patient. In such cases, euthanasia would mean snatching away the chances of a patient’s survival. There are many cases where mercy killing has often been misused. To prevent such manhandling euthanasia should be prohibited. Something that concerns the life of a person should not be left in the open for people to play around with.

Allgyer of Lake Forest, in the state of Illinois, for alleged violations of the Codes of Professional Conduct of the AICPA and also in relation to Securities and Exchange Commission (SEC) Rule 102 (e) about a rendition of professional services for Waste Management, Inc. wherein there was improper conduct by him. The integrity of Mr. Allgyer was questionable due to his issuance of an Order instituting Public Administrative Proceedings which the SEC construed as negligence on his part. However, Mr. Allgyer entered into a compromise settlement with thInstitutingich he was fined $50,000 and also suspended from his professional practice for two years, with a right to re-apply for the privilege of practicing before the SEC only after the lapse of five years. I think the disciplinary actions taken against him were too harsh (professional suspensions) considering that he paid the substantial civil monetary penalty of $50,000 (AICPA, 2012b, p. 1). Ru le 102 (e) of the SEC now allows it to sanction any individual CPA in addition to public accounting firms, the firms they worked for and their audit committees. This new rule change refers to negligence on the part of individual CPA which constitutes as improper conduct and a violation of professional standards of conduct applicable in the instant case (With a controversial change to rule†¦, 1999, p. 1). Rule 201 – this rule refers to professional competence and cares with regards to the handling of financial documents. It means any member must be competent in terms of academic theories (continuing professional education credits or CPE) and adequate work experiences. Moreover, this rule requires due professional care during rendition of any professional services by ensuring proper planning before any work is started, make adequate supervision during the performance of professional services and ascertain if there are enough valid data, documents and all relevant informati on for a reasonable conclusion or a proper recommendation with regards to all services standards (NYSSCPA.org, 2009, p. 1).Â
